Son appears in Pietermaritzburg court for allegedly robbing father
An elderly Slangspruit man has refused to pay his son’s bail and is seeking a protection order against him following an alleged assault and robbery.
An elderly Slangspruit father who had his son arrested for allegedly assaulting him, threatening him with a knife and robbing him was then asked to pay bail for the accused when he appeared in the Pietermaritzburg Magistrate’s Court on yesterday— a request he refused, reports The Witness.
Although Mzanywa Phillemon Ngwenya was the complainant in the case, a court orderly asked if he would be willing to pay bail for his son, Simphiwe Ngwenya (26), who is facing charges of domestic abuse.
Ngwenya, who appeared frail and reliant on a walking stick, told the court that on February 3 his son attacked him shortly after he returned from the police station, where he had opened a case of theft of corrugated iron sheets against him.
Ngwenya said police dropped him off at his home and after they left, his son pounced on him at the house in the Mele Supermarket area.
“He entered the house, pushed me, then shoved me to the ground. He took money from my pockets, leaving me with injuries,” he said.
Ngwenya told the court that during the incident, his son was armed with a knife, threatening and intimidating him.
“It appeared as though he wanted to kill me,” he said.
When his son fled, Ngwenya called the police, who later arrested his son.
He said he wanted a protection order against his son.
The accused briefly approached the bench when called by the magistrate to complete details of the protection order, but did not look at his father during the proceedings.
The protection order prohibits Simphiwe from entering his father’s home and bars any form of physical abuse or intimidation.
The court said a violation would result in immediate arrest.
Bail was set at R2 000, with the accused expected to relocate to an alternative address and not return to Slangspruit.
The case was remanded to May 21 for regional court allocation and further investigation.
