La Mercy building site raises compliance concerns

La Mercy residents can breathe a sigh of relief after fears that a large-scale building project could be used for student accommodation were dispelled, with the development confirmed as a private luxury home.

The property at 1 Coull Drive, with an entrance on Candleglow Place, had raised concerns among residents about potential noise and increased pressure on off-street parking.

eThekwini municipality’s marketing and communications director, Mandla Nsele, confirmed that the development has received prior written approval and meets all statutory requirements.

According to Nsele, the approved plans are for a residential dwelling comprising a new house, domestic quarters, a private gym, an entertainment room and garages.

He said the erf is zoned Special Residential 650, measures about 2 367m², and permits up to four units.

However, the approved plans make provision for only two units (first- and second-storey), with basement parking that complies with the definition of a basement.

He added that the gym and entertainment areas are ancillary outbuildings intended as shared facilities for the property.

Despite the municipality’s assurances, questions remain over compliance at the site.

ActionSA PR councillor in eThekwini, Saul Basckin, highlighted the absence of a building information board, as required in terms of Regulations A25 and A19 of the National Building Regulations.

The regulations require that a board displaying key details, including the approved plan reference number, a description of the development, and the names of the architect and engineer, be erected on site. Failure to do so constitutes a contravention of the Act and municipal by-laws.

While the municipality responded to queries regarding the approved plans, it did not address questions relating to the missing board.

The Courier was unable to locate the owner of the property.
