The trio of accused in the ‘Inkatha Freedom Party (IFP) case’ pleaded not guilty to two counts of conspiracy to commit murder. This plea was heard before the Estcourt Regional Court today (August 5).

The three accused are IFP councillor Mthembeni Majola, former Endumeni (Dundee) Local Municipality mayor Richard Mbatha and alleged hit-man Xolani Makhathini.
The court proceedings kicked off with a bang when accused number one, Mthembeni Majola, objected to the charges being read out by State Prosecutor Ms Nel.
Advocate Augustine insisted that amendments be made and the court stood down for the necessary changes to be made, after which the trial resumed.
Prior to the agreement that the charge sheet be amended, Advocate Augustine said:
“The defence takes great objection to the charge sheet. It is very vague and the accused objects to the charges. Conspiracy is a very serious offence involving communication. What if the defence has an alibi? The State had ample time to prepare a proper charge sheet. In addition, this is not sufficient for the accused.”
Firing on all cylinders, Advocate Augustine then asked the court if they will be making use of the ‘hear say’ evidence that was mentioned.
