Sex between consenting 12-year-olds and 15-year-olds is now legal

Sometimes, and I grind my teeth as I say it, our stupid Constitution gets it wrong!
A Bill has been passed decriminalising sex between consenting children. Yes, it was signed into law, all thanks to our wonderful Constitution.
Changes to the Criminal Law (Sexual Offences and Related Matters) Amendment Bill were adopted by the National Assembly last month.
It states that children between the ages of 12 and 15 can consent to sexual acts with each other.
In October 2013, the Constitutional Court found that Sections 15 and 16 of the legislation were invalid and ordered Parliament to amend them. This resulted in the decriminalising of sex between consenting children by Parliament.
This was apparently done in order to protect children against the old Statutory Rape charge.
A person older than 15 who sleeps with a 12-year-old will, however, be guilty of an offence.
Apparently, a 12-year-old can consent to having sex with a 15-year-old, but not 16 or older.
Should schools now provide beds in classrooms?
The question has to be asked: ‘What were the judges on the Constitutional Court benches thinking?’
The very idea that a 12-year-old boy or girl (who legally cannot drink, vote, buy cigarettes, play the Lotto, gamble, drive a car, own a gun or watch pornography) can be given Carte Blanche to have sex by our Constitution is dumbfounding.
If someone gets pregnant, who pays maintenance? Let’s be honest, the 12-year-old cannot even sign a legal document or legally work for that matter. But our glorious Constitution says it’s okay to “go-at-it” like bunnies.
Who do pregnant teens get to represent them in court, and how will custody battles be fought?
Can you imagine two 12-year-olds fighting it out in court over custody of a child? Yes, the absurdity of two children fighting over custody of a child is a distinct possibility.
I just give up!
