Patel awaits High Court decision
Limpopo High Court to rule on Rameez Patel's bid for leave to appeal his life sentence for the murder of his wife Fatima in Nirvana.
POLOKWANE – The Limpopo High Court is expected to rule today on whether convicted businessman Rameez Patel will be granted leave to appeal his life sentence.
Patel was sentenced to life imprisonment in December, by retired judge Joseph Raulinga after being found guilty of the premeditated murder of his wife, Fatima Patel, at their Nirvana home in 2015.
Through his lawyer, Saleem Khan, Patel is seeking permission for the judgment to be reconsidered by another court.
The application for leave to appeal was argued over three days in February. If granted, the appeal would allow a higher court or a full bench to reassess the evidence presented during the trial and determine whether the original judgment was correct.
Legal analyst Pfunzo Phosiwa said an appeal does not necessarily question the fairness of the presiding judge, but rather examines how evidence was interpreted.
He confirmed that appeals are common and often focus on whether certain aspects of evidence may have been overlooked.
The case against Patel relied largely on circumstantial evidence, including witness testimony and expert analysis. The firearm used in the killing was never recovered.
Patel was initially granted bail of R250 000 by the Polokwane Magistrate’s Court before the matter was transferred to the High Court. Following his conviction, however, his application for bail pending appeal was denied.
According to Khan, if the application for leave to appeal is refused, Patel will petition the Supreme Court of Appeal to have the matter reconsidered.
“The accused maintains his innocence and believes that a different presiding officer will consider the matter differently,” Khan said.
