Evander Magistrate’s Court denies bail to alleged cop shooter

Sifiso Nkosi submitted an affidavit, read by his attorney, in which he pleaded not guilty to the charges.

The Evander Magistrate’s Court denied Sifiso Nkosi bail on February 6, postponing his case to March 6. Nkosi faces charges of murder and attempted murder following a shooting in Ext 8, eMbalenhle, on the night of November 13 last year.

When the eMbalenhle police and emergency medical personnel arrived at the scene, they found two seriously wounded victims next to a vehicle.

The man succumbed to his injuries in the hospital on November 14, while the woman, a 32-year-old SAPS constable stationed at eMbalenhle, was rushed to the hospital for urgent medical care.

During his bail hearing, Nkosi submitted an affidavit, read by his attorney, in which he pleaded not guilty to the charges.

He claimed that he was not a flight risk, arguing that he had communicated with the police by phone about his whereabouts after the incident.

However, the investigating officer, Warrant Officer Melusi Mthombeni, disputed this claim when he took the witness stand.

Mthombeni testified that Nkosi had misled the police about his location before his arrest, falsely claiming to be in Piet Retief while he was actually in Potchefstroom. Private security companies assisted in tracking Nkosi down, and Mthombeni then requested assistance from the Potchefstroom police to apprehend him.

Mthombeni further told the court that Nkosi did not call an ambulance after the shooting. Instead, it was community members near the scene who alerted emergency services.

He also stated that during their journey back from Potchefstroom, Nkosi allegedly told the police that he would kill himself if given the chance.

Additionally, Mthombeni testified that when Nkosi was arrested, police found a firearm under the seat of his car. Upon checking its details, they discovered it was the same firearm that Nkosi had reported stolen in June last year.
