Under the gavel at the Scottburgh Magistrate’s Court: State withdraws case against mentally ill man

A young man who was in police custody for malicious damage to property has now been sent to hospital.

This week in the Scottburgh Magistrate’s Court:

• A 25-year-old man from Amandawe pleaded guilty to being in possession of 42 grams of dagga. He is unemployed, supports his younger siblings and mother and is a first time offender. He explained to the court that he does smoke dagga but doesn’t distribute it.

The young man was fined R200 or 20 days’ imprisonment.

• A man (50) was arrested last Monday after being found in the unlawful possession of ammunition. He is unemployed, has two children, is unwell and has a bad heart condition. He was  released on warning and is expected to report to Scottburgh police station every Monday  before his next court appearance on May 30. The case was adjourned for ballistic reports and further investigation.

• After several months in police custody, a young man finally had the state withdraw the charges for malicious damage to property. The incident happened last year when the accused was caught stoning shop windows in Scott Street. When he was arrested, he was not able to recall where he lived or where his family was.

After his first few court appearances, he was sent to Fort Napier Hospital for a mental assessment. It was established that he was not of sound mind and the state withdrew charges. He has been sent to GJ Crookes Hospital’s psychiatric ward for treatment.

• A 30-year-old woman was charged with fraud and made her first court appearance last Wednesday morning. The case had to be postponed to June 8 as the court awaited video footage and witness statements to be brought forward.
