Former Hibiscus Coast Municipality traffic chief, Dave Middleton is behind bars after bail was denied in the Port Shepstone Regional Court recently.
About two weeks ago, the High Court in Pietermaritzburg dismissed Middleton’s appeal against his conviction and sentence.
It’s believed that Middleton, now at the age of 69, will submit a petition to the Supreme Court of Appeal (SCA), which has to be filed within 21 days.
A bail application to determine whether bail should be extended pending the petition to the SCA was heard in the Port Shepstone Regional Court last week.
Middleton was arrested in early September 2013, when nude and semi-nude photographs of a smiling 13-year-old, as well as as well as a photograph of what appeared to be a child’s hand holding an erect penis, surfaced on his phone.
In 2018, Middleton was sentenced in the Port Shepstone Regional Court to five years’ imprisonment.
He was found guilty on nine of the 31 charges against him.
Two of these charges involved sexual assault of a child (10) and the production of child pornography and the sexual assault of a second child (13).
He spent 18 months in prison before being granted R30 000 bail at his fifth bail application in 2015.
