TAKE NOTICE THAT by summons sued out of this court, you have been called upon to give notice, within 30 days from date of service hereof, to the registrar and to the plaintiff`s attorney of your intention to defend (if any) in action wherein THE STANDARD BANK OF SOUTH AFRICA LIMITED claims:
1. Confirmation of
cancellation of the
agreement:
2. An order directing the Defendant to restore to the Plaintiff`s possession of the goods, being: VEHICLE: 2020 KIA PICANTO 1.0 STYLE ENGINE NUMBER: G3LAKD054978 CHASSIS NUMBER: KNAB2511LLT586291
3. Retention of all monies paid to the Plaintiff by the Defendant;
4. Leave is granted to the Plaintiff to apply for;
4.1 Damages, if any, in an amount to be calculated by subtracting the current market value of the Goods (as well as a rebate on unearned finance charges from the balance outstanding if applicable);
4.2Interest on the said damages at the rate of 17.600% per annum from 12 February 2026, both days inclusive;
5.Costs of suit on the attorney and client scale;
6.Further and/or alternative relief. TAKE NOTICE FURTHER that if you fail to give such notice, judgment may be granted against you without further reference to you. PLEASE TAKE NOTE that the Plaintiff opposes the referral of this matter to mediation. The Plaintiff does so for the following reasons: The Standard Bank of South Africa Limited (`Standard Bank`), the Plaintiff in this action, hereby confirms its election not to mediate in this matter at this stage. Standard Bank`s election is premised on the numerous attempts it has made to amicably resolve the matter with the Defendant (as further canvassed in the particulars of claim) and the parties have unfortunately not reached any suitable agreement.
