Police spokesman Capt Alfred Nakana said, at the time of the incident, the woman had obtained a protection order against her husband because they were always “arguing”.
However, the two are still living in the same premises.
“On the night of July 3, the husband reportedly approached his wife and begged her to share a bed with him as he felt too cold sleeping alone,” said Nakana.
Nakana said the woman agreed on condition that there would be no touching.
“Then during the night, the man forced himself on the woman,” said Nakana.
The man has been charged with rape and is due to appear soon in the Benoni Magistrates Court.
