FOLLOW UP: Justice is in limbo after cyclist’s death on Mercury Street

The case against the driver accused of fatally striking cyclist Donovan Theart was withdrawn, pending blood test results. As the investigation stalls, calls for justice grow louder.

The driver who allegedly killed local cyclist Donovan Theart in a crash on Mercury Street, Atlasville, has not yet faced formal charges, as authorities await toxicology results.

Theart, 50, was struck and killed on the morning of April 20 while on a routine ride. Two days later, on April 22, the suspect appeared briefly in court.

According to Benoni SAPS spokesperson Captain Nomsa Sekele, the suspect is believed to have been under the influence of alcohol at the time of the incident.
“Officials took a blood sample to determine the level of alcohol in the suspect’s system. The court provisionally withdrew the matter, pending the test results.”

Sekele explained that the case will be re-enrolled as soon as the toxicology results become available.
“The testing process at the lab can take time,” she said.
“The suspect initially faced charges of culpable homicide and driving under the influence, but the final charges will depend on the forensic findings.”

Theart’s untimely death has sent shockwaves through Boksburg and Benoni’s cycling community.
In response, over 400 cyclists gathered for a memorial ride on April 26, departing from the Bicycle Line at Summerfields Shopping Centre. The cyclists followed the same route Theart had taken on the day of the accident via Reier, Azalia, and Mercury roads before laying roses at the site where his life was cut short.

The event served not only as a tribute but also as a protest. Cyclists carried placards reading ‘Stop Killing Cyclists’ and ‘Share the Road’, calling attention to the growing dangers cyclists face and the need for greater driver awareness and accountability.

Theart, a well-loved figure among local riders, was remembered for his generosity, positivity, and encouragement of newcomers to the sport.
Benoni SAPS has urged the public to remain calm while investigations continue, assuring that updates will be provided as the case progresses.
