Pinetown homeowners’ river woes continue

EThekwini Municipality said the council is not responsible to protect private property from stream bank erosion if the stream runs through the property or within the property. It is the property owner's responsibility.

STREAMS running through properties causing damage are the homeowners’ responsibility, according to the municipality.

A story published on page 2 of the Highway Mail, dated 22 March 2019, about a river running through a garden in Pinetown, raised questions from another resident who experienced similar problems.

Martie and Vivian Kichenbrand said their problems started in March last year when their fence was damaged by a flow of water from a stream and the situation worsened as their yard was slowly being absorbed by the stream.

The confusing part about their situation, which still puzzles them, Is that they were told by the municipality this was their problem and that they should sort it out as the stream belongs to them when they do not even know the source of this stream.

Ashley resident, Norma Ngcolosi, said she was interested to know the outcome as she is facing a similar problem.

“I’ve been reporting the issue, but the municipality says it’s my problem. I’m paying full rates for the damaged yard that is a hazard to my family and the building. My yard is a mess but I’m expected to pay rates according to the size of my property, half of which was destroyed by the stormwater stream,” she said.

Last week, eThekwini Municipality’s spokesperson, Msawakhe Mayisela responded and said, “With regards to the stream that forms the boundary of the property, we have previously communicated with the resident explaining the Water Act and the Councils Policy with regards to erosion of stream banks.

“The council is not responsible to protect private property from stream bank erosion if the stream runs through the property or within the property. This is the property owner’s responsibility.

“However, any protection works proposed, will have to be designed and certified by a professional engineer and submitted to the Building Inspectorate for approval. Our officials will avail themselves to the complainant on site to clarify the matter and provide advice,” said Mayisela.

The Kichenbrand family also had another issue of a blocked stormwater drain opposite their gate which results in water seeping into their yard.
Mayisela said the stormwater line is completely blocked.

“This line will be unblocked urgently by the relevant unit. Once that has been completed, another department will then conduct dye tests to ascertain if there is a break in the line,” he said.
