ANTHONY Edward Ball’s (71) application for leave to appeal his sentence and conviction, and to have the proceedings reviewed, was on Friday (August 28) adjourned to September 23 at the Pinetown Regional Court.

Ball was convicted for the 2022 Kloof road murder of Dean Charnley and was sentences to 12 years imprisonment.

The court heard on Friday that the application could not proceed because Correctional Services had indicated a staff shortage, preventing it from transporting Ball to the court, and because the State prosecutor is indisposed the matter will be taken over by their colleague.

The new State prosecutor assured the court that they will prepare to ensure that there are no further delays.

Ball’s defence told the court that it intends to also make an application for bail.

Ball’s legal representative said they have learned that their client’s health has severely deteriorated.

“A serious situation has developed and this matter should receive serious and urgent attention,” said Advocate Gideon Scheltema SC for Ball.
