
EDITOR – In view of the horrific accident on Thursday 5 September, I want the community to note that justice will never prevail in this country.
Last year my son Robbie Bessell (an ex Ashley Primary and Pinetown Boys’ High pupil) and his friend Warren Mann were returning to their families in Johannesburg after completing the SANI2C mountain bike race when they were tragically killed.
They were hit head-on, also, by an out-of-control truck. They didn’t stand a chance. The truck driver was charged with culpable homicide, reckless and negligent driving. There was no mechanical failure whatsoever.
The case was heard last week in Harrismith and the sentencing took place today (Monday 9 September 2013).
The driver was advised by his attorney to plead guilty. He also pleaded leniency as he was a first-time offender, had 2 children and is a breadwinner.
This should not be taken into consideration. He should have considered this while speeding, driving recklessly and negligently.
What of Robbie and Warren, two well respected, hardworking, young family men who have left behind their families, their wives and a toddler?
The driver arrived late in the courtroom, which shows what little respect he has for our courts. He was then given a meagre fine of R10 000 or a 20 month jail sentence, half of which is suspended for four years.
Our families are shocked and dismayed at this. The truck driver however, learns nothing from this sentencing. He showed no remorse during the hearing, tried to avoid his actions and I can only imagine that he is delighted that a mere payment absolves him from any guilt.
My condolences to family and friends of the victims of last week’s tragic accident. We really do live in a very sad society.
