NATAL BUILDING SOCIETY (T5341/1980) NOTICE OF INTENTION TO APPLY FOR CANCELLATION OF MORTGAGE BOND IN TERMS OF THE DEEDS REGISTRIES ACT 47 OF 1937 Notice is hereby given that FAKKEL GEMEENTE (formerly known as the Dutch Reformed Church Fakkel), the registered owner of Erf 11507, Extension 45, Sasolburg, Registration Division Parys (now Sasolburg), Province of the Free State, held under Deed of Transfer No. T5341/1980, intends to make application to the High Court of South Africa, Free State Division, Bloemfontein, for an order directing the Registrar of Deeds, Bloemfontein, to cancel the registration of Mortgage Bond No. B8310/1980, dated on or about 1 January 1980 (alternatively registered on 16 May 1980), passed by the Dutch Reformed Church Fakkel for the sum of R30 000,00 (Thirty Thousand Rand) in favour of the Natal Building Society (now succeeded by First National Bank Limited and/or Nedbank Limited), hypothecating the aforesaid Erf 11507, Extension 45, Sasolburg. The said bond is an old and dormant encumbrance on which no payments or demands have been made or received for more than ten years, no records of any outstanding debt can be traced by the successors-in-title to the original bondholder, and despite diligent enquiries, no consent to cancellation can be obtained from the Second and Third Respondents. All persons having any objection to the proposed cancellation of the registration of the said bond are hereby required to lodge such objection in writing with the Registrar of Deeds at the Deeds Registry, 25 President Brand Street, Bloemfontein, 9301, within six weeks from the date of the first publication of this notice. Alternatively, should any person wish to oppose the court application, they are referred to the Notice of Motion and founding affidavit which will be served on the Respondents in due course.
