Jailtime for rapist with half a tongue

NELSPRUIT –  Rapist who had his tongue bitten by victim gets 10 years sentence. Sipho Sello Milazi Mokoena (35) was found guilty in the Nelspruit sexual offences court on Thursday.

He was found guilty of raping a 16 year old girl on February 26, 2012.

Magistrate Mr Roelf Smith gave the sentence of 10 years as the girl was not physically abused and over the age limit for child rape in the country which could have gotten him a life sentence. Smith added that he would not take the two years Mokoena had spent in jail into the sentence.  

“Rape is a cancer in our society, we have to send a clear message that these crimes will not be tolerated and the court has a duty to protect the women and children in this country.”   

Previously in court, Mokoena testified in his defence that he propositioned the victim claiming she was a prostitute.

During cross-examination from prosecutor Ms Elise du Plessis, he claimed the girl was on top of him when she bit his tongue

Du Plessis said that was not possible as the girl was found with blood all over her and the blood would not have been on her if she was on top of him. “The blood would have poured down not up.”

Previously, the girl had  testified in court that she had been walking to go buy bananas in Swalala. On the way there, Mokoena and a friend stopped her. She said he hit her in her face and indicated that his friend had a firearm.

The girl then stated that he took her into the bush where he proceeded to rape her.  She said when he had her on the ground and was raping her, she bit his tongue and fought him off her.

Mr Vincent Sipho Nkosi  who lived near the crime scene, also testified that on the day in question he had found the victim with hardly any clothes on covered in blood and shaking with fear.

“She was frightened and shaking.”  He said seeing her condition, he asked another neighbour to take the girl to the nearest hospital.
