Small Claims Court to be established in Newcastle

Deputy Justice and Constitutional Minister, John Jeffery recently published a notice in the Government Gazette stating a new Small Claims Court would be established in Newcastle.
Furthermore, courts would be formed in the Utrecht and Ndwedwe areas.
What’s the big deal?
Small Claims Courts have become a platform for applicants to institute minor civil disputes without having to hire an attorney. Claims are dealt with quickly and effectively, while keeping costs as low as possible.
Anyone is permitted to institute a claim with the court, provided they are not a juristic person, such as a company, close corporation or association.
An amount not exceeding R15 000 may be claimed in a Small Claims Court. However, if a claim exceeds the predetermined amount, the applicant may issue a lesser claim in order to pursue the matter.
The department listed the following causes of action as examples on its website:
– Delivery of movable and immovable property.
– Action against the occupier of a property.
– Actions for damages.
– Actions arising from liquid documents.
