Pistorius’ appeal decision not yet ruled
The Supreme Court of Appeal will issue a decision on Oscar Pistorius' appeal at a later date.
The Supreme Court of Appeal will issue its decision on the state appeal against the culpable homicide ruling by the High Court in the Oscar Pistorius case later after listening to arguments on Tuesday in Bloemfontein.
The National Prosecuting Authority (NPA) requested that Judge Thokizile Masipa’s culpable homicide judgement handed down last year, be overturned for murder.
Pistorius’ defence lawyer advocate Barry Roux was grilled by Justice Eric Leach on the details of the defence, asking if the Paralympian believed his life was in danger when he decided to shoot through the bathroom door.
He also questioned Judge Masipa’s legal point of dolus eventualis, saying her analysis seemed incorrect.
“He can be convicted of murder on the basis of dolus eventualis, even if he did think she was in the bedroom,” Leach said.
After the court adjournment, news broadcaster eNCA’s microphone picked up a conversation between Roux and state prosecutor advocate Gerrie Nel, in which Roux was overheard saying “..but that I am going to lose is a fact”.
It could not be confirmed what Roux was referring to.
Pistorius was released under correctional supervision last month after serving a year of his five-year sentence.
He was convicted of culpable homicide in September last year, for shooting and killing his model girlfriend Reeva Steenkamp in February 2013.
