THE widow of the late 800m world champion, Mbulaeni Mulaudzi, won a court battle against her husband's parents for his estate in the Thohoyandou high court last week.
THOHOYANDOU – THE widow of the late 800m world champion, Mbulaeni Mulaudzi, won a court battle against her husband’s parents for his estate in the Thohoyandou high court last week.
Tondani Mulaudzi from Masia village said her husband’s parents had taken all the property in question from her house in Louis Trichardt.
“With the help of my attorney, Wisani Baloyi from Wisani Baloyi Incorporated, I won the case in the Thohoyandou high court and the sheriff of the court engaged with the family in Muduluni village, where they collected the property on Friday,” she said.
Baloyi said the couple was married in community of property.
“In terms of Section 26 (1) of the Administration of Estates Act 66 of 1966, the executrix in a deceased’s matter is charged with a duty to take into her custody and control all the assets of the deceased’s estate,” he said.
He said the property that had been collected by the sheriff of the court included a small truck, dining room suite, a bench, a couch, a coffee table, two TV stands, a flat screen TV, a PVR decoder, a small silver decoder, two mats, a large mirror, a music system, a painting and two leisure chairs.
He said Tondani was self employed and took care of the couple’s child, Denga.
“The deceased had a R500 000 retirement annuity of which his mother was the beneficiary.
“My client intends to take this to court as well in order to have the policy pay out to the estate.”
The athlete died in a car accident in Mpumalanga on his way to attend an Athletics South Africa (ASA) meeting. His funeral was held on November 1.
The Mulaudzi family did not want to comment on the matter.
