YWP axeman trial continues

The trial of Yellowwood Park resident, Phindile Joseph Ntshongwana (37) who is accused of multiple murder, attempted murder, rape and kidnapping continued in the Durban Magistrate's Court from Monday, 20 January to Thursday, 23 January.

Defence witness Professor Abubaker Gangat was first on the stand on Monday. He testified to Ntshongwana’s mental illness, saying he was delusional. He stated that Ntshongwana, if convicted of the crimes, was not being able to appreciate the nature of his actions.

The court heard Ntshongwana did know the difference between right and wrong, but due to his mental illness, could not choose between two. In a response to advocate Rea Mina’s question of whether or not he was a danger to society, Gangat stated he was a danger. The possibility of him repeating the offences could not be ruled out. Proceedings revealed mental illness can be controlled with medication and since his incarceration, he had not attacked anyone.

Psychiatrist, Dr Soobiah Moodley, who was part of a panel which examined Ntshongwana for a month during his stay at Fort Napier, testified contradicting Gangat’s testimony. Dr Moodley referred to a witness who allegedly saw Ntshongwana put items into a plastic bag, therefore making his actions purposeful and his awareness thereof.

The trial has been adjourned for Wednesday, 29 January, when a date for its continuation will be set.
