Bluff panelbeaters and mechanics urged to comply with the law

To avoid possible arrest, detention, prosecution and a criminal conviction, business owners in the Bluff should ensure they are registered in terms of section 2 and 3 of the Second-Hand Goods (SHG) Act (Act 6 of 2009).

Brighton Beach police appeal to local mechanics and panel beaters who are not registered in terms of section 2 and 3 of the Second-Hand Goods (SHG) Act (Act 6 of 2009), to register and legalise their business immediately to avoid penalties and possible arrests.

In terms of section 62 of the National Road Traffic Act (NRTA) (Act 93 of 1996), panelbeaters are obligated to keep a record of every vehicle, motor vehicle and motorcycle that they repair as a result of a collision.

“Should any motor vehicle repairer, mechanic or panel beater business owner be of the opinion that his/her business does not fall within the ambit of the SHG Act, they are respectfully requested to contact Warrant Officer van der Merwe to avoid wrongful assumptions which may lead to an unpleasant confrontation with the law. The onus is on the mechanic or business owner to ensure they are registered in terms of the SHG Act,” said Brighton Beach SAPS spokesman Captain Louise Le Roux.

The current admission of guilt fine for contravening S32 (1)(a) read with Section 2(1) for failing to register is R2,500. To avoid possible arrest, detention, prosecution and a criminal conviction, business owners should email W/O Anton van der Merwe a vandermerweA4@saps.gov.za, for the application documents (SAPS 601: Application for registration as a second-hand good dealer/ recycler) or obtain the application form themselves from the SAPS website at www.saps.gov.za. Panelbeaters may also email W/O Van der Merwe to request a free pro-forma information (record) form, to be compliant with Section 62 of the NRTA (Act 93 of 1996).
