Ward 64 councillor’s assault case transferred to Durban Magistrate’s Court

The case has been transferred to Durban Magistrate's Court due to safety concerns for the accused, and space limitations at Wentworth court.

AN assault case involving Ward 64 councillor, Gavin Hegter, has been transferred to Durban Magistrate’s Court.

Hegter was appearing in the Wentworth Magistrate’s Court this morning (April 3) for a pre-trial conference. However, the magistrate presiding over the matter stated the case will be transferred to Durban due to safety reasons and space limitations at the Wentworth Magistrate’s Court.

On Hegter’s last appearance in court on March 28, the magistrate scheduled April 3 for a pre-trial conference.

A pre-trial conference is a meeting discussion between the legal representatives of the parties involved in a case where areas of dispute are clarified, evidence is exchanged and a trial date set.

Today more than 50 members of the uMkhonto weSizwe Party gathered in court to show support to the victim – a 43-year-old man who was allegedly assaulted by Hegter in November last year. Furthermore, ANC supporters were present to show support to the victim.

The State prosecutor said after much consideration between all parties, a consensus was reached that the Wentworth court cannot accommodate a large number of people.

As the case has moved to Durban Magistrate’s Court, the two witnesses were called but did not enter the witness box. They were advised that the court would call them to testify when needed.

Hegter is out on a warning. He will appear in the Durban Magistrate’s Court on April 10.
