Note that the above Application will be set down on the
08TH day of MAY 2026 at 10:00am on which date the Applicant will apply for Default Judgment to be entered against the Respondent in terms of Rule 31(2) and an order in terms of Rule 45 and Rule 46 and Rule 46A of the Uniform Rules of Court, for:
1. Payment of the amount of
R 612 055,88 (SIX HUNDRED AND TWELVE THOUSAND AND FIFTY FIVE RAND AND EIGHTY EIGHT CENTS);
2. Interest on the amount referred to immediately above at the rate of 12,750% per annum from 22 February 2024 to date of payment both dates inclusive;
3. Payment of the Monthly Insurance Premiums of R566,73 and Assurance Premiums of R2 290,09 until such time that the risk of the property passes completely and remains with a new owner;
4. That the immovable property described as:
ERF 1823 KAMAGUGU TOWNSHIP
REGISTRATION DIVISION J.T., PROVINCE OF MPUMALANGA
IN EXTENT: 241 (TWO HUNDRED AND FORTY ONE) SQUARE METRES
HELD BY DEED OF TRANSFER T17560/2014
SUBJECT TO THE CONDITIONS CONTAINED THEREIN
(`the Property`) be declared executable for the aforesaid amounts;
5. An order authorising the issuing of a writ of execution in terms of Rule 46 as read with 46A for the attachment of the Property;
6. That a reserve price be set for the sale of the Property, at a sale in execution, at a value to be determined by the Honourable Court;
7. Costs of suit on the attorney and own client scale;
