State opposes bail as officer testifies in child rape case

The matter resumes on June 3.

Warrant Officer Simon Modise took the stand as the 28-year-old man accused of raping and impregnating an 11-year-old Boksburg girl continued his bail application in the Boksburg Magistrate’s Court on May 28.

Modise, who is the investigating officer in the matter, was not in court at the previous appearance (May 22), but his affidavit was read out, in which he stated he believes the suspect is a flight risk.

During the proceedings on May 28, Modise testified that the 11-year-old girl was “very shy and withdrawn” when he interviewed her to take her statement.

The suspect’s defence lawyer, Frik van Rensburg, cross-examined Modise, questioning him about the child’s initial denial of ever having had sex when her mother asked her about it.

Modise responded by saying the child didn’t lie, explaining that children often feel fear before disclosing such offences.

“When such things happen to them, they don’t know what to say or how to tell their parents, because it’s shameful for an 11-year-old to admit they had sex. It’s normal for a child that age not to say anything until they are encouraged to open up,” said Modise.

Van Rensburg then asked: “Is that your opinion?”

Modise tried to respond by saying: “I know so because I’m dealing with a …”

The defence then asked Modise: “Is that your opinion – yes or no? Are you qualified to give such opinions in court, sir?”

Modise responded: “No.”

The cross-examination will resume on June 3.

The police arrested the suspect on April 22 and he first appeared in court on April 24.

Speaking to journalists outside the court, NPA spokesperson Phindi Mjonondwane said the State opposes the bail application.

A group of community members again protested outside the court on May 28, demanding justice for the child.
