Bester escape case: Girlfriend’s court challenge fails

The Free State High Court has ruled against the urgent application that was brought forward by Dr Nandipha Magudumana.

The urgent application brought by Nandipha Magudumana – the girlfriend of convicted ‘Facebook rapist’ Thabo Bester, and one of the accused in his prison break case – to challenge the legitimacy of her arrest in Tanzania has been dismissed with costs.

Magudumana claims her arrest was ‘unlawful and unconstitutional’ and filed an application with the high court, which was opposed by Home Affairs Minister Aaron Motsoaledi, the NPA and SAPS.

The Citizen reports that judgment in the matter was handed down by the Free State High Court in Bloemfontein earlier today.

The publication states that Judge Phillip Loubser ruled that Magudumana did not meet the ‘criteria for launching the application on an urgent basis’. He also rejected her argument that ‘her deportation from Tanzania was misrepresented as an extradition’.

OFM News reports that ‘the judge said the court does not have jurisdiction over her arrest in Tanzania and if she wishes to take up the manner of her arrest, she should do so with the Tanzanian authorities’.

Magudumana has been in custody since her detention.
