Mlotshwa stands firm under cross examination

Advocate Wayne Gibbs, for Willem Oosthuyzen, said that he believes that Victor Mlotshwa and Delton Sithole spoke before the trial and agreed on a date.

Mlotshwa made a statement to police on 8 November 2016 and Sithole on 10 November.

The state have not provided the defense with Mlotshwa’s original statement and Mlotshwa said that he signed but did not read through the typed version in the defense’s possession.

Adv. Robert Molokoane, for the state, objected to the typed version being handed in as evidence.

Adv. Gibbs said other discrepancies, such as on which vehicle Sithole was and their location when the assault on Sithole took place, exists.

Before court adjourned for the day, adv. Gibbs said that his client will testify that he came across Mlotshwa carrying a black bag and that he ran away when he waved for him to come closer.

He said that Oosthuyzen will further that he called in Jackson’s help when Mlotshwa crossed the railway line into his farm.

Mlotshwa denied the accused’s version.

Cross examination will continue tomorrow.
