Middelburg High Court hands 15-year sentence in murder of TRT officer

A Middelburg High Court ruling has brought a breakthrough in the 2021 murder case of a Tactical Response Team officer from eMalahleni, with one of the accused now sentenced to 15 years.

A major breakthrough in a long-running murder investigation was achieved this week when the Mpumalanga High Court, sitting in Middelburg, sentenced one of the accused in the 2021 killing of Witbank Tactical Response Team officer Sergeant Joseph Kutu.

The sentence was delivered this week in the Mpumalanga High Court sitting in Middelburg.

The case was driven to this point by extensive work from the Middelburg-based Hawks’ Serious Organised Crime Investigation unit.

Sgt Kutu, who was 43 at the time, was killed in July 2021 after returning home from deployment. According to evidence before the court, he arrived at his Vosman home to find that his wife was not there. She later returned and parked the couple’s vehicle in the garage.

The court heard that she allegedly entered the house with two men who opened fire on her husband. Kutu was rushed to hospital, where he died shortly after the shooting.

The case was transferred to the Hawks’ Middelburg-based Serious Organised Crime Investigation unit, whose work led to the arrest of three suspects, including Kutu’s wife. Two firearms, a handgun and a rifle, were also recovered during the investigation.

All three accused were initially denied bail, although Kutu’s wife was later released on R10 000 bail following an appeal.

Proceedings were set to continue on February 9, but were postponed to February 11 due to issues with legal representation. On that day, accused Xolani Ndabezitha (29) pleaded guilty and was sentenced to 15 years in prison. His co-accused, Bonginkosi Langa, has since indicated that he also intends to plead guilty, and his matter has been postponed to February 18.

The third accused, Sgt Kutu’s wife, is expected to appear in court on 17 January 2028.

Major General Nico Gerber, Provincial Head of the Hawks in Mpumalanga, welcomed the sentencing and said the unit remains committed to securing justice for the slain officer.

“One life lost is too many, especially a father and dedicated member who served this country. We are pleased that one of the accused has been sentenced, and we believe justice will be served in the remaining cases,” he said.
