Genesis Pub closes permanently after legal battle in Middelburg
Venue management confirms relocation after wrapping up operations on OR Tambo Street.
Management of the Genesis Pub has confirmed the venue will make a fresh start in Kempton Park after months of municipal pressure, police action, and resident friction.
In a joint statement released alongside Nicole Nik Entertainment, the venue thanked its local followers for their loyalty as it wrapped up operations on OR Tambo Street.
“It is with heavy hearts that we announce the Genesis Club journey in Middelburg has come to an end,” said a member of management.
The venue faced mounting pressure from neighbours, local police, and municipal officials due to its proximity to the Middelburg Police Station and Life Midmed Hospital.
Legal battle follows noise complaints
Complaints centred on excessive noise, with hospital spokesperson Helani Nel previously noting that loud disturbances near the medical facility interfered with patient recovery.
The pub was initially ordered to shut on April 17 following noise complaints, setting off a drawn-out courtroom tug-of-war.
After losing an appeal at the Supreme Court of Appeal in Bloemfontein, the owner, Siao Yin, submitted a reconsideration application seeking to pause the shutdown order and remain open pending review.
Town planning rules breached
Steve Tshwete Local Municipality spokesperson Lerato Kgomo confirmed that town planning procedures had not been followed, leading to municipal legal action.
While the Mpumalanga Economic Regulator acknowledged that the spot was licensed for alcohol under the name ‘Paradise’, it noted that managing noise and public nuisance was strictly governed by municipal by-laws.
Defending the club during the disputes, Yin argued that proper approvals had been secured from authorities and suggested the council buy out the premises if it wanted a total shutdown.
