Daubermann demands Judge Makaula recuse himself

The defence said that the judge wishing the victim well in her exams led him to think he was being sympathetic towards her.

Pastor Timothy Omotoso’s defence Peter Daubermann has applied on behalf of his clients, Omotoso and Sulani, for Makaula to recuse himself

Daubermann demanded that Judge Mandela Makaula recuse himself as he has made questionable judgments regarding the case.

He said Makaula allowed humanity to get the better of him “and unfortunately I have to criticize you on those comments”.

If Makaula grants Daubermanns request of another judge, first witness may have to testify again.

He outlined that Makaula wishing the victim well in her exams led him to think Makaula was sympathetic towards Zondi.

Quoting Makaula, Daubermann said comments such as “leave it to us” meant ” leave it to me to see that justice is done on your behalf”.

“I understand what happened, my lord, but it’s not your job to consult with the witness. A judge cannot hint bias.”

He said it was clear the judge had made up his mind.

Makaula said he will look into Daubermann’s submission and adjourned court for the second time on Monday.
