Civil rights organisation #NotInMyName has expressed dissatisfaction over Dros rapist Nicolas Ninow being granted leave to appeal his sentence.

Ninow petitioned the Supreme Court of Appeal after his leave to appeal his life sentence was refused by the Gauteng High Court in Pretoria in March last year.

He was sentenced to life imprisonment for the rape of a seven-year-old girl at a Dros restaurant in Silverton in the east of Pretoria in 2018.

The 23-year-old was sentenced to serve life imprisonment for two counts of rape, five years in prison for possession of drugs and another five years for defeating the ends of justice.

According to #NotInMyName Ninow has been granted leave to appeal and this would cause secondary trauma to the victim and the family.

“We want to reject his appeal out rightly with the greatest contempt. It is actually angering and frustrating for us to be even talking about him being granted the right to appeal his sentence,” said the organisation’s secretary-general Themba Masango.

“We reject this appeal and we say that Nicolas Ninow must finish the life sentence that was given to him. He must stay in jail and not be considered for any form of leave to appeal.”

The national prosecuting authority (NPA) confirmed that Ninow has petitioned the Supreme Court of Appeal, but no response had been given as yet.

“The NPA is still awaiting the SCA response and date,” said spokesperson Lumka Mahanjana. Rekord was yet to get confirmation from the Supreme Court of Appeal on whether Ninow had been granted leave to appeal.
