It’s been a long day in court with the four accused in the cannibalism case making a formal bail application.

At the outset the court was told that the four remaining accused Nino Mbatha, Sithembiso Sithole, Lungisani Magubane and Khayelihle Lamula will be charged under a schedule six offence – premeditated murder.

Accused number one, traditional healer Nino Mbatha did not apply for bail.

Court proceeding went on with questions from the lawyers for the accused Mr Ngcobo and Ms Hadebe and cross-examination from State Prosecutor Mr Zuma.

Sithembiso Sithole and Lungisani Magubane took to the witness stand and were questioned about their relationships with their co-accused.  as well as asked for.

Seeing that they are facing charges of conspiracy to commit murder and murder, which are serious offences and have lengthy prison sentences, they were asked to provide exceptional circumstances as to why the court should grant them bail.

Both accused testified that they had children and families to take care of and would not leave the country or escape the long hand of the law.

After lengthy questioning, Legal Aid lawyer for the accused Ms Hadebe requested that, seeing as it was already 3.10pm,  Khayelihle Lamula’s questioning be remanded as there wouldn’t be enough time for questioning.

The case has been remanded to November 10. All four accused have been remanded in custody.
