
Madam – The following Noise Control Regulations of the Environmental Conservation Act, 198 (Act 73 of 1989) refers. I think the public needs to be informed and their assistance would be appreciated to bring the culprits down.
Noise Control Regulations Environment Conservation Act, 1980 (Act 73 of 1989)
This must/need to be implemented within a suburban area where noise becomes a nuisance. Registration numbers must be taken down where and when any motorist plays amplified music, so that it will be addressed in accordance with the assistance of the local police where the Act will or need to be enforced.
In these regulations, any word or expression to which a meaning has been assigned in the Environmental Conservation Act. 1989 (Act 73 of 1989), shall have the meaning so assigned to it and, unless the text otherwise indicates –
“noise level” means the reading on an integrating impulse sound level meter;
“noise disturbance” means any sound which disturbs or impairs or may disturb or impair the inconvenience or peace of any person;
Powers of local authority
A local authority may –
– In order to determine whether a vehicle using any road in its area of Jurisdiction, including a private, provincial or national road crossing its area of Jurisdiction, complies with the provisions of these regulations, instruct the owner or person in control of the vehicle –
– To stop the vehicle or cause it to be stopped
– If a noise emanating from a building, premises, a vehicle, recreational vehicle or street is a disturbing noise/or noise nuisance, instruct in writing the person who causes such noise or is responsible therefore, to discontinue the noise or cause it to be discontinued such noise within the period stipulated in the instruction
General prohibition
No person shall –
Drive a vehicle, or allow it to be driven, on a public road, if the sound level at the measuring point, measured in accordance with the procedure prescribed in SABS 0181.
Prohibition of disturbing noise
No person shall make, produce or cause a disturbing noise, or allow it to be made, produced or caused by any person, animal, machine, device or apparatus or any combination thereof.
Prohibition of noise nuisance
No person shall –
Operate or play a radio, television, drum, musical instrument, sound amplified, loud speaker system or similar device that produces, reproduces or amplifies sound, or allow it to be operated or played so as to cause a noise nuisance
Penalties
Any person who contravenes or fails to comply with a provision of regulation 3, 4 or 5 shall be guilty of an offence and liable on conviction to a fine or imprisonment for a period for each day on which such contravention continues.
