Toti murder accused driver in court

Trial resumes on Friday, 30 May.

A CASE currently on trial at Durban Magistrate’s Court saw both the prosecution and defence teams re-visit the scene of an accident at Doonside robots on Monday, 26 May, where three-year-old William Ratcliffe was killed on Wednesday evening, 15 August 2012.

The toddler died after a Toti man alleged to be under the influence of alchohol collided with William’s mother, Suzette’s car. She was returning home at about 5.30pm with her two sons, William and James belted into their seats.
She had taken the Seadoone off-ramp and was travelling south in the intersection of Kingsway, near the vet, when her BMW collided with a beach buggy. 

According to senior public prosecutor, Barend Groen, the scene visit, which is not unusual, was to ascertain how the accident occurred. After the visit, both parties returned to court.

On Tuesday, 27 May an expert testifying for the prosecution said the driver of the buggy, Robert Gilmore had a blood alcohol concentration of 0.21g/100ml (grams per 100ml of blood) – more than four times the legal alcohol limit for drivers.
Gilmore has pleaded not guilty to a charge of murder, two of attempted murder and one of leaving the scene in relation to the accident.
The trial is expected to resume until Friday, 30 May.
