How to claim for municipal damage

The eThekwini Municipality has welcomed a filing of claims for damages that resulted from its negligence.

ETHEKWINI Municipality has reminded the public that its doors are open to those who want to claim for damages that resulted from the municipality’s negligence, as well as to those owing who want to register for the debt relief programme.

In a recent statement, the municipality’s spokesperson, Msawakhe Mayisela said the municipality’s self-insurance policy allows residents to claim for damades to property under the Public Liabilty Cover, only if the incident was because of negligence by eThekwini Municipality.

“The recent floods, however, were an act of nature, therefore the city is not liable for the loss incurred and will not honour claims related to flood damage to private property,” said Mayisela.

For incidents that were caused by acts of negligence on the parts of the municipality, residents can lodge a claim by downloading the public claim liability form from www.durban.gov.za and complete it. The supporting documents required along with the form are: copy of the ID, three quotations, proof of the damage, and a sworn affidavit indicating that the claimant is the owner of the property and that the claimant will not be claiming from personal insurance. These documents should be emailed to claims@durban.gov.za.

Mayisela further said customers in debt for over 90 days are reminded that they have the month of June to register for the debt relief programme, which will end on June 30.

“Customers that are 90 days in arrears can sign a payment arrangement with a 5% down payment for residential customers and 10% for non-residential customers. The interest accumulated will be written off once the payment arrangement has been entered into. However, if a customer defaults on the arrangement, all interest written-off will be reinstated. Existing customers on a payment plan will be afforded an opportunity to take part in this incentive as a once-off offering and such customers will have to make a similar payment arrangement,” he said.

The payment plan will be for the maximum period of 36 months with no interest added. Residents can go to the nearest Sizakala Centre for more information.
