NOTICE OF APPLICATION
FOR JUDGMENT INCLUDING AN ORDER TO DECLARE IMMOVABLE PROPERTY EXECUTABLE IN TERMS OF RULE 46 / 46A PLEASE TAKE NOTICE that the abovenamed Applicants intend to make Application to this court on the 23rd day of JUNE 2026 at 09h30, or so soon thereafter as the matter may be heard, for an order in the following terms:
1. That judgment is granted in favour of the Applicant against the Respondent
1.1 Payment of the sum of R4 379 706.48;
2. Interest thereon the sum at the rate of 13.05% per annum calculated and capitalised monthly in arrears, from 24 JANUARY 2025 to date of payment in full, both dates included;
3. Cost of suit on the attorney- client scale;
4. Any payment made to one Applicant pursuant to the money judgment set forth in paragraph 1.1 above, shall reduce the Respondents` liability to the other Applicant, in like amount;
5. The following immovable property is declared specially executable in favour of the Second Applicant: 26 CHURCHILL ROAD, SOUTHBROOM, (`the property`) The Respondent is granted 10 days leave to file a notice of intention to oppose from the first method of service being complied with to in the Substituted Service order granted on 4 NOVEMBER 2025. The Respondent may file aforementioned notice with the Applicants` attorneys of record by email at the following email address: jarid@johnstonkzn.co.za.
TAKE NOTICE FURTHER that should you fail to do any of the things mentioned in this Notice of Application, this may result in the court granting the orders prayed for above.
