INVITATION TO COMMENT ON AN APPLICATION: SUBMITTED IN TERMS OF CHAPTER 6 OF THE SPATIAL PLANNING AND LAND USE MANAGEMENT ACT, 2013 (ACT 16 OF 2013) READ IN CONJUNCTION WITH SECTION 27 (1) (A), (E) AND (J) OF THE UMHLATHUZE SPATIAL PLANNING AND LAND USE MANAGEMENT BY LAW, 2017 (AS AMENDED) FOR THE:
•SUBDIVISION OF PORTION 1 OF ERF 16177, RICHARDS BAY, TO CREATE PROPOSED PORTION 2 OF (ERF 1) OF 16177, RICHARDS BAY, AND REMAINDER OF PORTION 1 OF ERF 16177, RICHARDS BAY;
•REZONING OF THE REMAINDER OF PORTION 1 OF ERF 16177, RICHARDS BAY, FROM `AGRICULTURE 1` TO `TRUCK STOP`;
•REZONING OF THE PROPOSED PORTION 2 OF ERF 16177, RICHARDS BAY, FROM `AGRICULTURE 1` TO *NOXIOUS INDUSTRY`; AND
•REMOVAL OF RESTRICTIVE CONDITION 1. (C)(I) FROM TITLE DEED NO. T27849/2023.
: TRUCK STOP Notice is hereby given that the uMhlathuze Municipality is about to consider an application in terms of Sections 27 (1)(a), (e) and (j) of the uMhlathuze Spatial Planning and Land Use Management By-Law, 2017, (the SPLUM By- law) for:
•Subdivision of Portion 1 of erf 16177 to create Proposed Portion 2 of (Erf 1) of Erf 16177 and the remainder of Portion 1 of Erf 16177;
•Rezoning of the Remainder of Portion 1 of Erf 16177 from *`Agriculture 1` to `Truck Stop`;
•Rezoning of the Proposed Portion 2 of Erf 16177 from `Agriculture 1` to *`Noxious Industry`; and
•Removal of Restrictive Conditions 1. (c)(i) from Title Deed No. T000027849/2023
The application site is located at the Eco-Junction area, approximately 10 kilometres East of Richards Bay CBD and 5 kilometres West of Empangeni CBD.

A written objection against or representation concerning the proposal, which is clearly marked
•Subdivision, Rezoning and Removal of Restrictive Condition of Title of Portion 1 of erf 16177 to create Proposed Portion 2 of (Erf 1) of Erf 16177 and the remainder of Portion 1 of Erf 16177, Richards Bay`; and which clearly sets out the grounds for the objection should reach the Municipal Manager by (30 July 2026) on Email: MdumelaT@umhlathuze.gov.za (c.c. creg@umhlathuze.gov.za & MayiselaFT@umhlathuze.gov.za), or the Postal Address below.
A person objecting on behalf of a landowner must submit proof of being authorized to act on behalf of such an owner.
