Council meeting expected this week on ELM CFO charges

A special ELM council meeting is expected this week on the fate of suspended CFO Andile Dyakala against whom investigations into alleged personal conduct and gross professional negligence have now been completed.

ELM Municipal Manager Lucky Leseane confirmed this week that a special council sitting had been requested for Friday and that internal disciplinary investigations against Dyakala were completed.

It is expected that a recommendation will be made to council that Dyakala be formally disciplined.

However, the completed investigations are not necessarily the end of Dyakala’s legal woes as he could possibly face even further disciplinary and civil legal proceedings emanating from additional  misconduct allegations after his suspension more than a month ago.

These link to alleged defamation of Leseane on media platforms since his suspension and also possibly even further internal ELM investigations and charges linked to the same alleged behaviour.

Leseane has confirmed that he is considering sueing Dyakala in a civil court action due to defamatory statements made against him.

This week’s expected council sitting on Dyakala comes hot on the heels of a failed Labour Court urgent application last month to have his suspension set aside.

Completed investigations are expected to reveal Dyakala allegedly waged a disinformation smear campaign against prominent Vaal business and media personalities using his position and council resources to do so.

Dyakala’s anger management issues and alleged gross incompetence have repeatedly landed him in hot water with many, including his own superiors such as former acting Executive Mayor Khetiwe Ntombela who was subjected to extreme verbal abuse in a virtual Zoom meeting.

Ntombela applied for and gained a protection order against Dyakala but even after this no formal action was taken against the CFO by ELM council.

However the core charges against him relate to alleged gross incompetence and extreme negligence in financial affairs in general including managing debt plans involving Eskom and Rand Water, to which ELM owes almost R6 billion.

The Golden Triangle Chamber of Commerce (GTCoC) wants Dyakala probed for the illegal cancellation of smart meter service provider BXCSA’s contract in 2019 after BXCSA at own cost created multi-million Rand infrastructure and about 200 decent jobs, all of which were lost.

Non-payment by Dyakala of BXCSA invoices – as with many other service provider payments – led to job losses and service interruptions before he abruptly with Nkoane cancelled the contract without any back-up plan, leading to huge financial losses for ELM and BXCSA.
