Many of these properties have rules that relate specifically to children. It is therefore crucial that these rules are studied to make sure that they are aligned with your expectations before you purchase a property.
Rules relating to children
Common scheme rules pertaining to children include restricting children from playing in driveways, parking areas and other spaces like swimming pools where they may come to harm. Noise rules are also common.
In terms of the Sectional Titles Act all rules must be reasonable. If you are living in a scheme where there are unreasonable rules relating to children, or anything else, you can challenge their validity and enforceability.
Limit risks
From the trustees’ and body corporate’s point of view it is crucial that the common property is safe for children. Swimming pool areas should for instance be securely fenced off and children under a certain age should not be allowed into the area without constant adult supervision.
Studying the scheme’s rules prior to buying into a sectional title will avoid problems and possible legal issues later on.
