THE application for leave to appeal Anthony Edward Ball’s sentence and conviction, and to have the trial proceedings reviewed is due back at the Pinetown Regional Court on Wednesday (September 23).

Ball’s legal representative Advocate Gideon Scheltema SC previously told the court of an intention to also apply for bail. 

Ball was recently convicted of the 2022 Kloof Road murder of Dean Charnley and was sentenced to 12 years’ imprisonment.

Scheltema previously told the court that the State prosecutor had been “compromised” due to their involvement in past unsuccessful applications for access to the investigation diary.

Additionally, the defence said the State prosecutor had failed to disclose to the court a statement by a key witness which was in the docket before the said witness made another one, and that the deceased’s wife Robyn was in possession of the docket.

The defence sought the review so that a higher court could determine whether a failure of justice materialised during proceedings.
