Two sentenced in Middelburg High Court for sergeant’s murder

Two accused was sentenced by the Mpumalanga High Court in Middelburg for murder of Sgt Joseph Kutu. Accused wife, out on R10 000 bail.

Sentencing was heard earlier today, 18 February in Middelburg for the murder of Sgt Joseph Kutu, with prison terms of 15 and 20 years imposed for two of the three accused.

Recounting court proceedings

The Mpumalanga Division of the High Court sitting in Middelburg has handed down sentences to two of the three accused in the murder and house robbery. The life of Sergeant Joseph Kutu was taken on the tragic day in Vosman, Emalahleni.

This follows years of court appearances, after the fatal shooting of the 43-year-old Sergeant Kutu in July 2021.

The victim

Sergeant Joseph Kutu was attached to the Witbank Tactical Response Team. He was killed after returning home in Vosman, from work. He later died in hospital from gunshot wounds.

Accused three – 15 years behind bars

On 11 February 2026, accused number three, Xolani Ndabezitha (29) from Kwaggafontein plead guilty to all charges. He was sentenced to 15 years direct imprisonment, by the Mpumalanga Division of the High Court sitting in Middelburg.

Accused two – 20 years conditional sentence

When the matter returned to court on 18 February 2026, accused number two, Bonginkosi Langa, plead guilty as well. The court sentenced him to 20 years imprisonment. Five years were suspended, on condition that he is not convicted of a similar offence. The court included a declaration that he is unfit to possess a firearm.

What happened

The court heard that the murder formed part of a house robbery at Sergeant Kutu’s Vosman home. Two firearms were previously recovered during the investigation, which strengthened the case against the accused.

The crime was not random – it was planned.

Accused one – still to face trial

Accused number one, Patricia Kutu, the deceased’s wife, was released earlier on R10 000 bail. Her next court appearance is set for 17 January 2028. Her case remains before court and has not been finalized yet.

Slow wheels of justice

Nearly five years after, Sergeant Kutu’s death, the court has now delivered significant sentences for two of the accused. While proceedings are still ongoing against the deceased Sergeant’s wife, these judgments marks a major step.
