A renewed bid by Brooklyn residents in Pretoria to stop the construction of a multibillion-rand skyscraper development to house students in a residential area has failed.
The High Court in Pretoria yesterday dismissed an application by the Brooklyn and Eastern Areas Citizens Association (Beaca), for a temporary interdict to halt any further construction of the block of flats by developers Caliber 651, pending an appeal against the rezoning rights granted to Caliber.
Caliber in May 2016 obtained rezoning rights for four properties in Brooklyn, allowing them to build 360 flats on half a hectare, with heights varying between five and eight storeys.
Acting Judge HMS Msimang said there was nothing in the case to suggest that the plans for the flats were illegally obtained, or that the plans were approved against the city’s rezoning requirements.
Msimang said Beaca had not provided the court with any facts that would justify an interdict and simply hoped there was a chance that the tribunal would rule in its favour.
