
The Potchefstroom Regional Court has sentenced 37-year-old Elias Tshetla Tautsepata, to two life terms plus three months imprisonment for rape and contravening the Immigration Act.
Tautsepata was convicted on two counts of rape relating to an incident that occurred on January 16, 2023 in Ikageng. Evidence presented in court revealed that the victim, who was in a relationship with the accused, was repeatedly raped at her place of work after Tautsepata confronted her with accusations of infidelity. The following day, the victim reported the ordeal to her employer, leading to his arrest two days later. He was denied bail and remained in custody throughout the trial.
During sentencing, Prosecutor Annecke Du Toit stressed the need for the court to send a strong message to both the accused and society at large. She argued that the judiciary must protect the dignity, equality, and freedom of women and should not deviate from the prescribed minimum sentences.
In delivering the judgment, the court noted the aggravating circumstances, including the accused’s lack of remorse, and declared him unfit to possess a firearm. His name will also be added to the National Register for Sex Offenders.
The National Prosecuting Authority (NPA) welcomed the sentence as a reaffirmation of the justice system’s commitment to addressing sexual violence. “This ruling reinforces the judiciary’s zero-tolerance stance on sexual violence and affirms the collective resolve of the NPA and law enforcement partners to pursue justice without fear or favour,” the NPA said in a statement.
The Director of Public Prosecutions in the North West, Dr. Rachel Makhari, praised the work of Prosecutor Du Toit and other role players for securing the conviction, adding that the outcome reflects the justice system’s determination to safeguard victims’ rights.
