New legal twist in councillor’s assault case

THE trial of Ward 64 councillor Gavin Hegter, scheduled to take place at the Durban Magistrate’s Court on June 11 and 12, was once again adjourned, this time after the accused introduced a new legal representative at the last minute.
Hegter appeared in court on June 11, where his newly appointed lawyer requested a postponement. He cited prior commitments in other courts representing other clients.

However, the magistrate issued a stern warning to Hegter’s lawyer, urging him to be considerate of the witnesses and other parties who were prepared to proceed with the case as originally scheduled.
The accused is facing charges of assault after he allegedly assaulted Mncedisi Dlamini (45) with a torch in November 2024, following an argument between the two. Dlamini and his friends were having a party at the state-owned property in Yellowwood Park last year when the accused asked them to lower their voices.
It is alleged that upon Hegter’s arrival at the gate Dlamini’s brother, who was a security guard at the property at the time, was present when the alleged confrontation between the accused and the victim ensued.
Following discussions between the State and the defence, the court agreed to adjourn proceedings.
The trial has been rescheduled for June 19 and 24. During the two-day hearing, witnesses for both the State and the defence are expected to testify.
