Pre-trial hearing scheduled for Ward 64 councillor charged with assault

Hegter is accused of hitting Mncedisi Dlamini with a torch on the mouth in November 2024 following an alleged argument between the two.

A PRE-TRIAL conference in the assault case of Ward 64 councillor Gavin Hegter will be back at the Durban Magistrate’s Court on May 15.

Hegter made his brief court appearance on April 10 following the transfer of his matter from Wentworth Magistrate’s Court to Durban court. He is charged with assault with an intent to do grievous bodily harm.

The case was adjourned for a pre-trial conference to be held between the prosecution and defence to streamline the trial process.

The case has sparked public interest with political parties like the ANC and uMkhonto weSizwe calling for justice to be served.

Hegter is accused of hitting Mncedisi Dlamini with a torch on the month in November 2024 following an alleged argument between the two. Mncedisi is the brother of the security guard, Alfred Dlamini.

According Hegter’s affidavit, he had complained about the noisemakers who were having a party at the abandoned house in Yellowwood Park where Mncedisi was visiting.

When Hegter approached the gate, he encountered Mncedisi, who was outside the house, and asked for a security guard.

According to an affidavit from Hegter, Alfred then came out of the house and approached the gate to talk to the accused. The affidavit states that Mncedisi was reportedly displeased with Hegter’s questions regarding visitors who were making noise.

The affidavit also alleged that an argument  broke out between Mncedisi and the accused, during which Dlamini was allegedly struck on the mouth with a torch.

A case was reported to Montclair Police Station and the accused was served with summons to appear in court.

Hegter is currently out on a warning.
