APPLICATION FOR DEFAULT JUDGMENT
BE PLEASED TO TAKE NOTICE that application will be made to the above Honourable Court on 18 JUNE 2026 at 10h00, or as soon thereafter as the matter may be heard for Default Judgment to be entered against the First and Second Respondents, for:
1. Payment of the sum of R799,640.32.
2. Interest thereon at the rate of 12.95% per annum from
1 September 2024.
3. An order in terms whereof the immovable property described as:-
A unit consisting of –
(a) Section No. 468 as shown and more fully described on Sectional Plan No.
SS541/2021 in the scheme known as OXFORD HEIGHTS in respect of the land and building or buildings situate at ERF 1766 MONTANA TUINE EXT 53 TOWNSHIP, LOCAL AUTHORITY: CITY OF TSHWANE METROPOLITAN MUNICIPALITY of which section the floor area, according to the said Sectional Plan is 53 square metres in extent.
(b) An undivided share in the common property in the scheme apportioned to the said section in accordance with the participation quotas endorsed on the said sectional plan.
HELD BY DEED OF TRANSFER ST52642/2022
is declared specially executable.
4. The Registrar is authorised to issue a writ of execution against the immovable property in terms of Rule 46(1)(a)(ii) read with Rule 46A(2)(c).
5. The Court to determine a reserve price.
6. Costs to be taxed on attorney and client scale.
7. Further and/or alternative relief.
