Case over RDP house postponed

Civil suit over arrest postponed.

MBOMBELA – An RDP homeowner in Tekwane North has taken her fight to keep her house to the civil court.

Lowvelder previously reported on Ms Engelinah Dibakoane who claimed she was unlawfully and forcefully removed from her RDP house by a police officer. The officer, Sgt Billa Samon who lives in the house with Ms Bafikile Madonsela, claimed the house legally belonged to his relative and that Dibakoane and her family occupied the house illegally.

She was subsequently arrested on charges of fraud, for allegedly faking in writing the proof that the home, of which the ownership was being contested, belonged to her. When the charges were provisionally withdrawn, Dibakoane sued the police for unlawful arrest. The case was postponed in court last Thursday. Her partner Mr Peter Shai, told Lowvelder they were suing the SAPS for an amount exceeding R100 000.

According to their legal representative, the case was postponed because the state attorney hadn’t shown up for the court appearance. A new date has yet to be determined.

In the meantime, there has been no progress on the house being restored to Dibakoane, despite a court ordering last February that possession be returned to her.
