Education awaits feedback from court on proposals

MBOMBELA – The Department of Education is awaiting feedback from the court on proposals it has made about the feeding-scheme tender it was ordered to readjudicate.

In May the High Court had ordered the department to readjudicate its three-year feeding-scheme tender after seven companies took it to court for allegedly awarding the contract irregularly to
17 service providers to manage and operate warehouses and supply bulk foodstuff, as well as fresh vegetables and fruit to schools participating in the nutrition programme.

The awarding of the tender was set aside on May 26 by judge Ms Nicoline Janse van Nieuwenhuizen, who gave the department 30 days to readjudicate the tender. She also ordered the premier Mr David Mabuza, former MEC for education Ms Reginah Mhaule and HOD Ms Mohlasedi Mhlabane to pay the legal costs on an attorney and client scale of the losing bidders.

Mr Jasper Zwane, spokesman for the department, said last week it had adhered to the order. “We went back to court to indicate the steps taken and made some proposals. We are currently awaiting feedback from the court. As such the matter is sub judice.”
