
MBOMBELA – The regional public consultations on the proposed Road Accident Fund Benefit Scheme Bill (RABS Bill) were held at the Valencia Community Centre on Monday, 15 September.
The proposed legislation intends to remove the “fault” requirement from the current list of prerequisites for the lodgement of a Road Accident Fund claim.
Under the current Act, a claimant will be entitled to claim from the RAF if he or she has suffered damages due to the faulty driving of a motor vehicle by another person within the borders of South Africa.
When this requirement does not precede a claim in terms of the proposed legislation, the wrongdoer in a motor vehicle accident and his or her family will also be able to claim from the RABS-scheme to the same extent as the victim who did not cause the accident.
This amendment to the current situation was questioned at the consultations yesterday, along with other proposed terms of the RABS Bill.
