Illegal stand deal leaves local man livid

An Emjindini man is livid after a stand he bought from sacked councillor, Lucky Sambo in February 2014 has as yet not been transferred to his name, nor has he received a refund of the money he had paid.

Themba Nelson Msibi (32) said he bought a residential stand from Sambo on February 13, 2014.
The vacant residential stand in question is erf number 8035 in Extension 14 at Emjindini.

“I was lured by Sambo to buy the empty stand. I paid him R20 000 in cash on February 13, 2014 at his house at Phola Park. He told me that the selling price of the stand was R25 000 and we made a verbal agreement that I will pay the remaining R5 000 in instalments,” said Msibi.
He said Sambo did not give him any official documents regarding the stand. “He showed me the stand before I purchased it. But now I find it difficult to occupy because I have no title deed, which gives me the right to occupy it,” said Msibi.

He said ever since he paid Sambo the R20 000, he (Sambo) was started playing hide and seek.
“I went to his house at Phola Park and made several phone calls to enquire about the latest on the stand, but all my efforts ended in vain. I have also spoken to the local African National Congress (ANC) leaders – because at the time when he tricked me, he was a councillor serving in their political party – but they are unhelpful,” said Msibi.

He said what incited him more was the fact that the ANC appears to be protecting Sambo’s corrupt activities.
“When I started to complain about him, I heard he was arrested and charged with fraud. He was later sacked by the ANC. But after a few days, he was having a new job as a community liaison officer in a huge RDP housing project in Emjindini. How can a corrupt individual be employed in a project rolled out by the ANC-led government when they know his corrupt activities very well,” asked Msibi.

Sambo resigned as councillor effective from October 1, 2014. This was after he was arrested on September 16 by the Hawks for fraud and theft.
Johan Badenhorst, Umjindi chief operations officer, said they are aware of Msibi’s issue. “People must remember that the transaction was illegal as it was done between the said councillor and the complainant and no paperwork went through to the council offices,” he said.
