Eskom notice for power cut; but court order still intact

Before the power can be cut Eskom must first overturn the ruling or have it set aside.

LYDENBURG – Residents are up in arms about yet another notice issued for the disconnection of this town’s power due to non-payment by Thaba Chweu Local Municipality (TCLM).

Although this notice was placed in the newspaper, the high court order which prevents Eskom from cutting the power still stands. Earlier this year, the three combined business chambers of TCLM took the municipality and Eskom to court for electricity cuts with regard to TCLM’s non-payment to Eskom.

The chambers of Lydenburg, Graskop and Sabie won the case. The judgment was delivered in the High Court of Pretoria on March 7.

The court said the constitutional duty rests with the municipality having been supplied with bulk electricity from Eskom to provide electricity to the end user.

Before the power can be cut Eskom must first overturn the ruling or have it set aside.

The notice stated that power cuts could be implemented from January 23 to 30, 2020.
